Agreement Regarding Supply of Electricity to Tea Garden Labour Quarter in Assam Valley

SHORT RECITAL :

 

 Present to various rounds of meeting convened by the Government and Discussion held between the Management of tea estate, the workers represent by the Assam State Electricity Board, it was decided to further examine the matter at the meeting of the State Standing Labour Committee. In this connection, the meeting convened on the 27th September, 1995 by the Hon'ble Chief Minister, and preceding meeting of the 12th April, 1995 may also be referred. As per the decisions of the above referred meeting and the emergent meeting of the State standing Labour Committee convened on the 6th June, 1995 in which the representatives of the ASEB were also present, the another meeting of the state standing Labour Committee to discuss matters in Connection with the electrification of labour quarters on the 19th October, 1995

Following detailed discussions, between all parties it is decided that the terms  of supply electricity to labour quarters would be as per the following. The terms as enumerated hereunder were examined by their consent obtained on the same.

 

Terms of Supply of Electricity to Tea Garden Labour Quarters in Assam:

 

(1) It was decided that the tea industry would extended grid power supply to the labour quarters and electric them in a phased manner over a period of five years commencing form this year, subject to drawing to H.T. line by ASEB and entergising of step-down TRANSFORMER/ TRANSFORMERS as may be necessary at suitable location/locations. The electrification of labour quarters would be decided depending on the economic condition of the gardens, their size and other such creteria as relevant, would be taken into consideration.

(2) The management of tea estate agreed that the cost of internal wiring and maintenance inside the quarter would be entirely borne by the Management.

(3) It was agreed by the parties concerned that each quarter would be provided with 4 (four) light point and 1 (One) plug point  only to be used exclusively for lighting purpose for domestic use only.

(4) It was agreed all the parties that the cost of procuring electrical bulbs would be the responsibility of the individual worker and the Management would not be required to supply the same at any point of time except at the time of initial installation.

(5) It was agreed that any extension of electric points of unauthorized tapping of electricity of any form of mal-practice as defined by the Terms & Conditions of Supply of the ASEB would render the worker liable for disconnection of electric supply at once,

(6) For the purpose of metering of consumption of electricity and payment of tariff by the workers, the point of metering would be the transformer point and the ASEB would serve the energy consumption recorded by the energy meter installed at the sub-station point initially to the Management of the garden, who in turn would be authorised to deduct the energy bill form the workers, The above referred meter would be for a cluster  of electrified labour quarters and each labour quarter falling within the cluster will have to share the consumption charged recorded in the cluster meter equally with others in the cluster.

(7) The rate of tariff applicable would be the prevailing tariff as notified by the A.S.E.B. for domestic consumers form time to time. The current domestic rate of tariff to be effective for tea garden labour quarters was clarified by the Board to be as below:

 

TARIFF :-

 

1) Domestic: Consumer whose average daily consumption falls in the following range:-

 

a) Up to 4Kwh per day.........                                      Rs. 1.00

b) Above 4Kwh and up to 8 Kwh per day...              Rs. 1.50

c) Above 8Kwh per day......                                        Rs. 2.25

 

The level of consumption for application of the rate would be decided as per following formula:-

 

Daily average consumption                          

                                                          =       Total unit  consumed through the transformer in a period.

 

                                                                    Total No. of labour quarters X days for which meter reading is taken.

 

a) If the daily average consumption is up to 4 unit and for that period would be Rs. 1.00 per unit.

b) If the daily average consumption is above 4 unit and up to 8 unit, the rate for that period would be Rs. 1.50 per unit.

c) If the daily average consumption is above 4 unit and up to 8 unit, the rate for that period would be Rs.2.25 per unit.

d) Period means period covered by two consecutive meter readings.

 

(8) The recovery of energy consumption charges determined on the basis as referred above would be every moth form the wages of the worker in whose weekly of fortnightly payment made to workers, recovery towered payment of monthly energy bill will be made form four weekly of two fortnightly payments.

(9) It was agreed that the electricity would be  made available to the labour quarters as long as grid power is available form the ASEB source and in the event of load shedding/shutdown failure of grid power form ASEB for any reason whatsoever, the supply of electricity to labour quarters would automatically be discontinued till restoration of grid  power, and the Management would not be liable in any way to supply electric form their sources including standby generating sets.

(10) It was agreed that the Management would not be responsible for any hazard or accident that may happen to any occupant of electricity and internal

wrings. Management will take appropriate action to educate the workers on proper use electricity its conservation and precaution to be taken against any accident and hazard.

(11) It was confirmed by all the parties concerned that in the event of any damage to the electrical installations solely attribution to the negligence and default of the occupant concerned, the Management to the extent of damages cause.

(12)  It was further clarified by all concerned that following the cessation of employment of the official occupant of the labour quarters, the worker would require to hand over the Company quarters to gather with the Electrical installation therein in a proper state to Management.

(13) Gardens without a factory and gardens without grid been assigned an correction at present will not come under the preview of the agreement.

(14) It was clarified and agreed that a  worker having been assigned an electrical quarters would into way be barred form being transferred to another quarter.

(15) In case of marriage , death ceremony, extension of temporary light points will be allowed by the Management on application and the occupant of the house will be charged extra tariff as determined by the Management for the extra consumption if electricity an the amount will  be realised form the wages of the concerned worker.
