SHORT RECITAL OF CASE:
The Memorandum of Settlement dated 10th
January, 1993 having expired on 31st March 1996. The ACMS approached the
Employers Association that the revision of wages for daily rated workers
should be discussed. Accordingly bilateral negotiation took place between
the Assam Chah Mazdoor Sangha and Employers Associations representing the
Tea Industry in the
Brahmaputra Valley on different dates. Following discussions a settlement
was arrived at on the 12.6.1996 at Dibrugarh on the following terms:
Terms of Settlement:
1. The existing rates of wages of the daily
rated workers in the tea estate of Brahmaputra valley will be increased as
follows.

2. The Employers Association
raised the question of stagnation in labour productivity of the Union to
increased productivity. The revision
of plucking rates was discussed thereafter in course of the several rounds
of discussion but it was not possible to arrive at any consensus. The
matters was however left open for further discussion at on opportune time.
3. This agreement will be deemed to be a
"Settlement" as defined in Section 2(p) of the Industrial Disputes Act
and will for binding on the parties as provided for in Section 18th of the
said Act. This Agreement will cover the Period up to 31st October 1999 and
the Union agrees that they
will not raise any industry wise demand or dispute during this period on
respect of the rates workers in the Brahmaputra Valley.
4. The increasing wages as provided for in
Clause 1 this agreement shall be added to the current rates of daily
allowance for plucking as per Clause (5) of the Agreement dated 27.3.1993.
5. This agreement will be effective form
1st May 1996 and the arrears for April 1996 @ RS. 1.50 per day for non adult
worker along with other arrears arising out of this agreement will be paid
within 30th September 1996.6. The Union also raised the
issue of equalisation of the rates of wages for various Zone, but
it was left open for discussion in future.
