SHORT RECITAL

The Memorandum of Settlement dated 18th December, 1994, bilateral discussion took place between the Employers' Association and the Union , for revision of pay scales of Rated Employees as raised by the Union on different dates, Following discussions on 28.3.1995 at Dibrugarh a settlement was arrived at on the following terms:

Terms of Settlement:

1. (a) With effect form 1st April 1994 the new pay scales will be as follows for the Assam Valley;

                                                                FOR ESTATE OF 200 ACRES AND ABOVE:

                                                                GRADE I                 Rs. 710-12-830-15-980

                                                                GRADE II               Rs. 675-11-785-14-880

                                                                GRADE III             Rs. 630-11-740-14-880

                                                                           FOR ESTATES BELOW 250 ACRES

                                                                GRADE II                 Rs. 675-11-785-14-925

                                                                GRADE III               Rs. 630-11-740-14-880

1. (b) On the basic pay as per scale mentioned on Clause 1.(a) Dearness allowance of 40% will be paid

1.(c) The basic pay Dearness Allowance as per Clause 1 (a) and (b)  of the Memorandum of Settlement will together correspond to the average All India Commissioner Price Index Number for the year 1993 being 1511 (1949=100).

1.(b) The fitment of the employees in Grade I, II and II will be as shown in Annexure A, B, and C respectively.

1.(e) Since the fitment in the Annexure has been shown based on the basic pay as on 31.3. 94. employess covered by this agreement will be given an increment in the new pay scales as on 1.4.94 subject to the maximum in the respective scales of pay.

1. (f) To neutralise any rise in the average All India C.P.I. Number there will be a provision for payment of VDA during the 12 month periods beginning 1st April 1995 and 1st April 1996. For the above periods, the VDA will be paid at the rate of 0.3% of basic pay per point rise in the average increase in the All India CPI Number during the calendar years 1994 and 1995, subject to the maximum of 20 point rise during any of these periods. Any excess over this limit in a year will be carried for ward to the subsequent year within the period of agreement.

1. (g) Arreas payable as result of the fitment of the employees in the new  pay scales illustrated in Annexure A, B,& C will be paid within 30th April 1995.

2. The Agreement will remain valid up to 31st March, 1995

3. The gardens in financial distress shall refer the matter to the concerned Branch Secretary, Assam Chah Mazdoor Sangha and the Secretary of their respective Employers Associations who will decide by discussion among themselves about the mode and date of payment of arreas.

4. During the pendency of this agreement the Employed and the Union will not raise any industrial disputes in respect of the issue covered by this agreement.
