MEMORANDUM OF SETTLEMENT

SHORT RECITAL

 

The Assam Chah Mazdoor Sangha raised certain demands before the State standing Labour Committee for consideration. The Chairman of the Committee desired that the Union and the Employer Associations should discuss and try to resolve the demands through bilateral discussion. Both parties accepted the suggestion and agreed to sit for bilateral discussion. Meanwhile the  ACMS added few more demands and requested the Employers' Association to include these in the proposed discussion.

Accordingly bilateral parleys were held between the ACMS and the AVBCCPA on various dates and after protracted discussion held today at Dibrugarh a settlement has arrived at on some issues on the following terms conditions:

 

TERMS OF SETTLEMENT

 

1.Issue of Firewood to Non-Resident  Permanent Workers:

All non-resident permanent workers who are entitled to receive firewood at the scale of 150 Cft. per annum as per Memorandum of Settlement dated 11th May 1988 will receive firewood at the scale of 228 Cft. per per annum  with effect form the next issue of firewood due to the workers for the year 1995.

2. Daily Allowance to Factory Workers:

To bring about reasonable party of earnings of pluckers and daily rated factory workers during ticca plucking season, it is agreed that the additional amount of 50 paise paid to the adult factory workers per day in addition to his/ her daily wage during ticca plucking period vide Agreement dated 29.11.1986 be raised to Rs. 1/- (rupee One) per day for adult factory workers with effect form 1/7/1994.

3. Individual Water Point to Sub-Staff Quarter:

In regard to Union demand for individual water point to the quarters of sub-staff and other monthly rated employees, the Employers Associations stated that the process have already started in many gardens and this would continue. The Employers Associations expressed their inability to sign a formal agreement in this regard but agreed to issue appropriate recommendation to their members to provide individual water point to the sub-staff quarter and complete it by December 1997. The Union agreed to the proposal submitted by the Employers Associations.

4. Issue of Mosquito Net:

In consideration of recrudesce of Malaria in the tea garden areas and in order to include the habit of using mosquito net among the workers, the Employers Associations agreed to make on e time issue of cotton mosquito net to the permanent resident and non-resident worker family. The size of the mosquito net will be:

Height   60"  Inches

Length  72"  Inches

Breadth 54" Inches

 

The cloth will be selected and approved jointly by the Assam Chah Mazdoor Sangha and the  Assam Valley Brahmaputra Consultative Committee of Plantation Associations. where necessary the nets will by the NMEP. The issue of nets will be completed by 31st March 1995.

The Assam Chah Mazdoor Sangha assured the Employers Associations that they would ensure that the mosquito nets are used by the workers and not disposed off. Nets will be issued to the workers on production of the one earlier given them by the management in the year 1991.

The Employers Association and ACMS agreed to sit for discussion on the other issues pending on a mutually conventional date.
