SHORT RECITAL OF CASE:
The parties to the negotiation
having arrived at an agreement on the subject of plucking rate in the tea
gardens in the Assam Valley vide Terms of Settlement, dated 10th
January,193, and as per Clause 3 of the said Terms of Settlement, met at
Guwahati on the 27th of March 1993 for district wise daily allowance
for daily rated workers and other details connected with the plucking rate.
Following threadbare discussions between the parties at Guwahati on the 27th
of March 1993, the following settlement was arrived at:

1.The daily allowance of the daily rated pluckers (workers), who work for
the full day in the tea estates of Brahmaputra Valley, will be as follows:

2. In addition as per Clause 3 of the terms of settlement dated 10th
January, 1993, the Pluckers will be entitled to 27 paise per kg. of green
leaf plucked.
3. The rates of minimum wages as applicable on a time basis will be
quantity to all pluckers irrespective of quantity of leaf plucked provided
they worked for the full day.
4. A pluckers who has worked for half a day
will receive payment at 27 paise per kg. for amount of leaf plucked plus
half the daily allowance as shown in clause 1 above.
5. Any further increase in wages during the
operation of this agreement shall be added to the daily allowance detailed
in Clause 1 above. 6. The existing rates of
plucking commission payable to Sirdars as applicable to individual estates
shall not be affected by this agreement.
7. The earnings of half kilograms of plucked
leaf will be taken at 14 paise but where amount of leaf is less than half
kilogram this will not be taken into consideration.
8. This agreement
is to be read in conjunction with the terms of settlement dated 10th
January, 1993 settlement dated 17th October, 1977.
