SHORT RECITAL:

 

The terms of the Government Notification GLR (RC) 127/8/pt/19 dated 20th February, 1990 fixing the Minimum Wage of Daily Rated workers employed in Tea Plantations in Assam expired on 31st October,1992. The ACMS approach the Employers Association and Government of Assam that  the revision of wages for Daily Rated Workers should be discussed and settle bilaterally as was done earlier and this has been accepted by the Government of Assam and the Employers Associations. Accordingly, bilateral negotiation took place between the Assam Chah Mazdoor Sangha and Employers Associations representing the tea Industry in the Brahmaputra Valley on variations dates and eventually a new agreement revising the wages of Daily on 10th January, 1993 at Guwahati on following terms:

 

Terms Of Settlement:

 

1.(a) The existing rates of wages of the daily rated workers in the tea estate of Brahmaputra Valley will be increased as follows:

2. The arrears of wages form the 1st November,1992 will be paid within March, 1993.

3. The Employers Associations raised the question of stagnation in labour productivity and stress the need for cooperation of the Union to increase productivity. The also mentioned about the stagnant leaf pice currently applicable and demanded an increase in the leaf piec to increase productivity in labour.  Accordingly a revised plucking rate was agreed upon as below: With effect form ticca plucking season 1993 the minimum plucking task will be 21 (twenty-one) kgs. and the plucking rates per kgs. above the minimum plucking task will be 27 (twenty-seven) paise per kg. The daily allowance for adult workers during the ticca plucking season 1993 will be as an illustration Rs. 14.43 for gardens in Dibrugarh, Sibsagar, Tinsukia, Jorhat and Golaghat Districts. For other Districts a detailed rate will be worked out. Any increase in wage and increase in wages as in Clause 1(a) will be be added to the daily allowance in season subsequent to 01-4-94.

4. The Employers Association expressed concern at the growing trend of absent of permanent workers and discussed ways and means with the Union appreciate the garden management in their effort to reduce absenteeism.

5. This agreement will be deemed to be a "Settlement" as defined Act and will be binding on the parties as provided for in Section 18th of the Said Act. This agreement will cover the period up to 31st March, 1996, and the Union agrees that they will not raise any this period in respect of the rates of wages for daily rated workers in the Brahmaputra valley.
