SHORT RECITAL:

The Memorandum of setttlement dated 4th July, 1982 followed by the settlement dated 1st August 1983 having expired on 31st March 1985, bilateral discussion took place between the Employers Associations and the Union for revision of pay scales of subordinate Staff and Other monthly Rated Workers on 30-4-85, 2-7-85, 31-7-85,3008085,18-10-85, 18-11-85 and a settlement was reached on the following terms:

Terms of Settlement:

1.(a) With effect form 1-1-85 the new scales of pay for sub-ordinate and other monthly rated workers will be as follows:

For Estates of 250 acres and above:

Grade II: Rs. 265-6-325-8-405

Grade III Rs. 235-6-295-8-375

For Other Estates

Grade II : Rs. 265-6-325-8-405

Grade III : Rs. 265-6-295-8-375

(b) ON the new basic pay fixed Deraness Allowance of 40% will be paid

(c) The fitment of employees in garden Ii & III will be as shown in Annexure A & B respectively.

(d) Since the fitment in the Annexures has been as based on the basic pay as on 31-3-85, employees covered by this agreement will be given an increment in the new pay scale as on 1-4-85 subject to the maximum of pay.

(e) It was mutually agreed to provide for a new promotional grade i.e. Sub-ordinate and Other Monthly Rated staff Grade 1 in the following scale: Grade I: Rs. 285-7-355-9-445

The new scale will apply to estate covered by Clause I (a) of the agreement and will be effective form 1-11-85 with the next increment being payable on 1-4-86

The norms and criteria for promotion form Grade II to the newly introduced Graade I will be discussed between the Parties and decided within 31-12-85

(f) To neturalise any rise in the average All India C.P.I. Numper there will be provision for payment of V. D.A. during the 12 month periods beginning 1st April 1986 and 1st April 1987. For the above a periods, the V.D.A. will be paid at the rate of .03% of the

basic pay per point rise in the average increase in the All India C.P.I. Number during the claender years 1985 and 1986, subject to the maximum of 20 points rise during any of these periods. Any excess over this limit in a year will be carried forward to the subsequent year within the period of the agreement.

(g) Averages payable as a result of fitment of the employees in the new pay scales as illustrated in Annexure A & B will also be paid before Faguna 1986.

2. The agreement will remain valid upto 31-8-1988.

3. The gardens in financial distress shall refer the matter to the concerned Branch Secretary, Assam Chah Mazdoor Sangha and the Seceretary of their representative Employers' Associations who will decide by discussion among themselves about the mode and date of payment of arreas concerned it being agreed that in no case the implementation of the agreement in full shall be dererred beyond 1-1-1986

4. During the pendency of this agreement the employees and the Union will not raise any of the issues covered in this Agreement.
