Sahu " SHORT RECITAL: As per clause 1 (f) of the Memorandum of Settlement dated 4th July, 1982 several bilateral discussion took place between the parties regarding the new scheme but the parties failed to reach an agreement. Eventually at a bipartite discussion on 1st August, 1983 the parties arrived at a settlement on the following lines; Terms of Settlement: (a) The basic pay and D.A. as er Clauses 1 (a) and (b) of the Memorandum of Settlement dated 4th July 1982 will together corresponded to the average All India C.P.L. number for the year 1981 being 536 (1949-100). (b) To neutralise any rise in the average AICPI number there will be a provision for payment of V.D.A. during the 12 month periods beginning 1st April, 1983 and 1st April, 1984. For the above periods, the V.D.A. will be paid at the rate of 0.3% of the basic pay per point rise in the average increase in the ACPI number during the Calender years 1982 and 1983, subject to the maximum of 20 points rise during any of these periods. Any excess over this limit in a year will be carried forward to the subsequent year within the period of the agreement. (c) The agreement arising out of this agreement will be paid within 31st October,1983 (d) This Agreement remain 31st valid upto 31-3-19-85.
