MEMORANDUM OF SETTLEMENT

SHORT RECITAL:

 

     The tenure of the Industry wise agreement dated 16th March, 2000, on wages for daily – rated workers in the Assam Valley having expired on the 31st December, 2003, the Assam Chah Mazdoor Sangha demanded revision of wage rates, accordingly, bipartite negotiations took place between the Assam Chah Mazdoor Sangha and the Employers’ Associations on Various Dates at Dibrugarh.    

             

   In course of discussions the Employers’ representatives pointed out the difficulties of the Industry. It was also pointed out that productivity issues need to be addressed immediately.

 

    Finally an agreement on the question of wages for the daily rated workers of the tea gardens in the Brahmaputra Valley was arrived at on 30th November, 2005 at Dibrugarh on the following terms:-

 

TERMS OF SETTLEMENT:

 

1. (a) There will be an increase in the daily wages of Daily Rates Workers as follows: 

                    

                                   Period                                                                  Adult

 

From            01/11/2005 to 30/04/2007                           Rs.    2. 60 per day

From            01/05/2007 to 30/08/2008                           Rs.    3. 70 per day

From            01/09/2008 to 30/12/2009                           Rs.    3. 70 per day

                   

 b) However, since the previous agreement expired sometime back, the employers

 agree to pay a sum of Rs. 204/- (Rupees two hundred four ) only to each daily rated worker and Rs. 102/-(Rupees two hundred four ) only to each non adult for full attendance during the period three months i.e. 01/ 08/ 2005 to 31/ 10/ 2005 and proportionately less for lesser attendance during same period. This amount will be paid within 31st March, 2006,

 

2. The increase in wages as provided for in Clause 1 (a) of this agreement shall be added to the current rates of daily allowance for plucking.

 

3. The in arrear of wages from 01/ 11/ 2005 to 30/ 11/ 2005 will also be paid within 31st March, 2006. Any garden having any difficulty regarding payment of arrear wages should approach the local Branch Offices of the ACMS for necessary accommodation.

 

4. The Employers Associations raised the need to address the issue of productivity. It is agreed that in view of the diversity in productivity patterns across the region, the issue of incentives/ disincentive will be negotiated and settled by tea estates at the local level in consultation with the Branch of ACMS through negotiated productivity schemes.

 

5. This agreement will be deemed to a “Settlement” as defined in Section 2(p) of the Industrial Disputes Act and will be binding on the parties as provided for in Section 18 of the said Act.
