SHORT RECITAL:

 

  The Memorandum of settlement dated 30th June, 1998 having expired on 31st March, 2000, Bilateral Discussions were held between Employers’ Association and the Employees’ Union for revision of pay scales for sub-ordinate staff and other monthly rated employees as raised by the union on various date.

 Following several round of discussion, finally on 10th August, 2001 at Dibrugarh, a settlement was arrived at on the following terms. 

 

TERMS OF SETTLEMENT

1. (a). With effect from 1ts April, 2000, new scales will be as follows for the   Assam Valley :  

  

FOR ESTATES OF 250 ARES AND ABOVE 

 

GRADE     I            :    Rs. 1178- 17- 1348-21- 1558

GRADE    II            :    Rs. 1133- 15- 1283- 18- 1463

GRADE    III           :    Rs. 1078- 15- 1228-18 -1408

 

FOR ESTATES OF BELOW 250 ACRES:

 

GRADE    II            :    Rs. 1133- 15- 1283-18-1463

GRADE    III           :    Rs. 1078-15- 1228-18- 1408

 

1.(b) On the Basic pay as scales mentioned in Clause 1(a), Dearness Allowance of 40% will be paid.

1(c). The basic Pay and Dearness  Allowance as per Clause 1(a) and 1(b) of the Memorandum of Settlement will together corresponded to the average All India consumer price Index Number for year 1999 being 254 (1949- 100).

1(d). The fitment of the employees in Grades, I II & III will be as shown in Annexure A B & C respectively.    

1(e). Since the fitment in the Annexure has been shown based on the basic pay as on 31st Mach, 2000, employees covered by this Agreement will be given an increment in the new pay scales as on 1/4/2000 subject to the maximum in the respective scales of pay.

1 (f).  To neutralise any rise in the average All India Consumer Price Index Number there will be a provision for payment of VDA during the 12 months period beginning 1st April 2001 and 1st April, 2002. for the above periods, the VDA will be paid at the rate of 0.3% of the basic pay per point rise in the average increase in the All India Consumer price Price Index Number during the calendar years 2000 and 2001, subject to the maximum of 20 points rise during any of these periods. Any excess over the limit in a year will be carried forward to the subsequent year within the period of the Agreement.

1(g).  Arrears payable as a result of the fitment of the employees in the new pay scales as illustrated in Annexures, A, B & C will be paid within 6th November, 2001.

2. The Agreement will remain valid up to 31st March 2003.

3. The gardens in financial distress shall refer the matter to the concerned Branch Secretary, Assam Chah Mazdoor Sangha and the Secretary of their respective Employers’ Association who will decide by discussion among themselves about the mode and date of payment of arrears.

4. During the pendency of this Agreement the employees and the Union will not raise any industrial disputes in respect of the issue covered by this Agreement

5. This Agreement will be deemed to be a “Settlement” as defined in Section 2(P) of the Industrial Disputes Act and will be binding on the parties as provided for in Section 18 of the said Act.
