MEMORANDUM OF SETTLEMENT

            The tea industry of Assam Valley represented by five Employers’ Associations, Namely:

1.  Indian Tea Association;

2.  Tea Association of India;

3.  Bharatiya Cha Parishad ;

4.  Assam Tea Planters’ Association ;

5.  North Eastern Tea Association;

        And

  The Employees’ represented by the Assam Chah Mazdoor Sangha.

SHORT RECITAL:

The Memorandum of settlement dated 28th March, 1995, having expired on 31^st March, 1997, bilateral discussion took place between the employers’ Associations and the Union, for revision of pay scales for subordinate staff and other Monthly Rated Employees as raised by the Union, on different dates, following several rounds of discussions finally on 13^th June, 1998 at Dibrugarh, a settlement was arrived at on the following terms:

TERMS OF SETTLEMENT:

1(a). With effect from 1^st April, 1997, the new pay scales will be as follows for the Assam Valley:

FOR ESTATES OF 250 ACRES AND ABOVE:

GRADE     I                   : Rs.930-13-1080-18-1260

GRADE     II                  : Rs. 890-13-1020-16-1180

GRADE     III                 : Rs. 840 -13-970-16-1130

FOR ESTATES BELOW 250 ACRES:

 GRADE     II                    : Rs.890-13-1020-16-1180

 GRADE    III                    :  Rs.840-13-970-16-1130

1(b). On the basic pay as per scale mentioned on the clause 1(a) Dearness Allowance of 40%will be paid.

1(c). The basic pay and Dearness Allowance as per clause 1(a) and 1(b) of the  Memorandum of settlement will together correspond to the average All India Consumer Price Index Number for the year 1996 being 2000 (1949 = 100) .

1(d). The fitment of the employees in Grades I, II & III will be as shown in Annexure A. B & C respectively.

1(e).  Since the fitment in the annexure has shown based on the basic pay as on 31st March, 1997, employees covered by this agreement will be given an increment in the new pay scales as on 1/4/ 1997 subject to the maximum in the respective scales of pay.

1(f).  To neutralize any rise in the average All India C. P. I. Number there will be a provision for payment of V. D. A. during the 12month periods beginning  1ts April, 1998 and 1st April, 1999. For the above periods, the V. D. A. will be paid at the rate of 0.3% of basic per point rise in the average increase in the All India C. P. I. Number during the calendar Years 1997 and 1998, subject to the maximum of 20 point rise during any of these periods. Any excess over this limit in a year will be carried forward to the subsequent year within the period of the agreement.

1(g).  Arrears payable as a result of the fitment of the employees in new pay scales as illustrated in ANNEXURE A, B & C will be paid within July 1998.

2.    The agreement will remain valid up to 31^st March, 2000.

3.    The gardens in the financial distress shall refer the matter to the Concerned Branch Secretary, Assam Chah Mazdoor Sangha and the Secretary of their respective Employers’ Associations who will decide by discussion among themselves about the mode and date of payment of arrears.  

4.    During the pendency of this agreement the Employees and the Union will not raise any Industrial Disputes in respect of the issues covered by this agreement.

5.    This agreement will be seemed to be a “Settlement” as defined in Section 2(P) of the Industrial Disputes in Act and will be binding on the parties as provided for in Section 18 of the said Act.
