An agreement between the Assam Branch
Indian Tea Association on behalf of their member gardens in the Assam Valley
and their workmen represented by the Assam Chah Mazdoor Sangha for the
purpose of any upward or downward revision of cold weather tasks as
envisaged in clause 10 of the wage Board agreement of the 26th February,
1966. 1. For the purpose of this
agreement "Task" will include all operations performed during the cold
weather period i.e., approximately October to March but shall not include
plucking of leaf and Hazira work unrelated to completion of any set amount
of work.
2. Although tasks that were in existence
during the cold weather of 1964-65 will be used as the basis for determining
the necessity for any revision of tasks as envisaged in the preamble to this
agreement, no claim for compensation will lie in respect of any task that
was in existence period to cold weather of 1966-67.
3(a) Managements of those gardens where
any task is considered to be too low and where an increase is proposed will inform the Branch Sangha
concerned with a copy to the Circle Chairmen and the A.C.M.S. headquarters
giving details of the existing task, the task in existence during cold weather 1964-65
and the proposed increase. 3(b) Branch
Sangha will furnish a list of gardens to the A.B.I.T.A. Circle
Chairmen concerned with a copy to both A.B.I.T.A. and A.C.M.S. headquarters
giving details of any task they consider to be too high having regard to the
provisions of Clause 10 of the Wage Board agreement.
4. The Branch Sangha and the A.B.I.T.A.
Circle Chairman concerned will arrange prompt discussion between the garden
Managements and the Garden Sangha in which representatives of both the
Branch Sangha and the Circle Chairman will participate, and any
adjustment of tasks agreed upon will be recorded in writing and signed by
all present. A representative of A.C.M.S. Headquarters will act as observer.
5. Where discussion on adjustment of
task fail at the level stated in Para 4 above, the matter will be referred to a Committee to set up in each
zone consisting of two representative each
form A.B.I.T.A. and A.C.M.S. 6. Cases
where task were increased during the cold weather of 1966-67 without any
signed agreement with the workers, and there was no reversion to old tasks
will be considered as matters of top priority and the discussion as per No
3(a) above will be completed by the 20th
November 1967 and will include the question of compensation payable, if
any, on the basis of the fair task determined.
7. In case where tasks were increased
during cold weather 1966-67 without any agreement with the workers and
workers subsequently reverted to the old tasks.
(a) Workers will be compensated to the
extent of the difference between their actual earnings and the new
fair wage provided that the old task was completed in full. If the old
task was not completed in full, compensation will be payable prorata to the
new fair wage. Such compensation will be payable by 30th November, 1967
(b) These case will be considered as the next
priority after the cases falling under Clause 6 above and the discussion as per
Clause 3 (a) above will be completed be 30th November, 1967 and will include
the question of further compensation payable, if any on the basis of
the fair task determined, and tasks actually performed.
8. Where possible discussions under the
above clauses may be held on a Company rather than an individual garden
basis, but concerned Garden Sangha must be associated in them.
