SHORT RECITAL:
The Memorandum of Settlement dated 18th
November, 1985 having expired on 31st March, 1988, bilateral discussions
took place between the Employers' Associations and the Union for revision of
pay scales of sub-staff and Other Monthly Rated Workers on 14.3.98, 16.5.89
and a settlement was reached on the following terms:
TERMS OF SETTLEMENTS:
1. (a) With effect form 1.4.88 the new
scales of pay for subordinate and other monthly rated workers will be as
follows:
For Estates 250 acres and above:
Grade I : Rs. 355-9-445-11-555
Grade II : Rs.330-8-410-10-510
Grade III : Rs.295-8-375-10-475
For Estate below 250 acres
Grade I : Rs.330-8-410-10-510
Grade II : Rs.295-8-375-10-475
(b) on the new basic pay a fixed DA of 40%
will be paid.
(c) The basic pay and DA as per Clauses
1(a) And (b) of the Memorandum of Settlement will together correspond to the average All
India Consumers Price Index Number for the year 1987 being 874 (1949-100)
(d) The fitment of employees in Grade I ,II
and III will be as shown in Annexure A, B, and C, Respectively.
(e) Since the fitment in the Annexures has
been shown based on the basic pay as on 31.3.88, employees covered by this
agreement will be given an increment on the new pay scale as on 1.4.88.

(f) To
neutralise any rise in the average
all India C.P.I Number there will be a provision for payment of VDA during
the 12 month periods beginning 1st April, 1989 and 1st April. 1990. For the
above periods, the VDA will be paid at the rate of 0.3% of the basic pay per
point rise in the average increase in the All India C.P.I Number during the
Calendar years 1988 and 1989, subject to the maximum of 20 points rise
during any of these periods. Any excess over this limit in a year will be
carried forward t the subsequent be within the period of the agreement.
(g) Arrears payable as a result of fitment
of the employees in the new pay scales as illustrated in Annexures A, B, and
C will be paid within a period of six month the date this agreement. 2. The agreement will remain valid
up to 31.3.1991.
3. The
gardens in financial distress shall refer the matter to the concerned Branch
Secretary, Assam Chah Mazdoor Sangha and the secretary of their respective
Employers' Associations who will decide by discussion among
themselves about the mode and date of payment of arrears
4. During the pendency of this agreement the
employees and the Union will not raise any industry wise dispute in respect
of the issues covered in this Agreement.
