MEMORANDUM OF SETTLEMENT BETWEEN NORTH ESTERN
TEA ASSOCIATION AND ASSAM CHAH MAZDOOR SANGHA

Representing the Employees SHORT RECITAL The Memorandum of settlement dated 18th November, 1985 having expired on 31st march 1988, bilateral discussions took place between the Employers Association and the Union for revision of pay scales of Sub-Staff and other Monthly Rated Workers on 14. .3. 98, 16. 5. .89 and a settlement was reached on the following:- Terms of Settlement: 1.(a) With effect form 1.4.88 new scales of pay for sub-ordinate and other monthly rated workers will be as follows: For Estate 250 acres and above Grade I : Rs. 335-9-445-11-555 Grade II : Rs. 330-8-410-10-510 Grade III: Rs. 295-8-375-10-475 For Estate below 250 acres Grade I : Rs. 330-8-410-10-510 Grade I : Rs. 295-8-375-10-475 (b) on the new basic pay a fixed D.A of 40% will be paid. (c) The basic pay and D.A. as per clauses 1 (a) and (b) of the Memorandum of Settlement will together correspond to the average All India Consumer Price Index Number for the year 1987 being 874 (1949-100) (d) The fitment of employees in Grade I, II and III will be as shown in Annexure A, B, and C respectively. (c) Since the firment in the Annexure has been shown based on the basic pay as on 31-3-88, covered by this agreement will be given an increment In the new pay scale as on I ,4, 88 subject to the maximum in the respectively scales of pay. (f) To neutralise any rise in the average All India C.P.I. Number there will be a provission for payment of V.D.A. During the 12 month periods beginning 1st April 1989 and 1st April 1990. For the above periods, the V.D.A. will be paid at the rate of 0.3% of the basic pay per point rise in the average increase in the All India C.P.I. Number during the claender years 1988 and 1989, subject to the maximum of 20 points rise during any of these periods. Any excess over this limit in a year will be within the period of the agreement. (g) Arrears payable as a result of fitment of the employees in the new pay scales as illustrated in Annexure A, B, and C will be paid within a period of this agreement. 2. The agreement will remain valid upto 31.3.91. 3. The garden in financial distress shall refer the matter to the concerned Branch Secretary, Assam Chah Mazdoor Sangha and the Secretary of their respective Employers Association who will decide by discussion among themselves about the mode and date of payment of arreas. 4. During the pemdency of this agreement the employees and the Union will not rise any industry-wise dispute in respect of the issues covered in this Agreement.
