SHORT RECITAL: The Union have been demanding for some time employment of additional workmen on permanent rolls, considering that the area under tea and the crop has increased substantially since 1978. They also pointed out that area gardens are employing a much larger number of temporary workers to cope with the increased leaf harvested. Management of temporary workers arising due to change in the cultural practices, technological changed, longer period of harvesting, the extent of absenteeism etc. in the tea gardens. While reteraing their stand that the demand for employment of labour on the basis of land-labour of crop-labour ratio is not acceptable, the employers indicated their willingess to offer permanent employment to a certain number of persons on an adhoc basis, Following a series of meetings between the parties, the matter was finally settled at Dibrugarh on 10.10.1988. Terms of Settlement; Without prejudice to the views of either party in this matter and to any rights conferred by any agreement, award or law- 1. Tea Estate in Assam (Bharamaputra Valley) will offer permanent employment to 23,000 persons in addition to those on the permanent roll as on 1.1.1988 preferably drawn form suitable unemployment persons on the estate who are employed as temporary workers form time to time the employers associations would decide on the process and method of distribution of these persons and a statement showing garden-wise appointment of this additional labour force will be provided to the Unions as soon as this is done. The industry should complete enrolment of these permanent workers within 30th June, 1989 2. The Industry will maintain the level of employment of permanent workers obtaining as on the 1st January 1988 added with the additional employment given as per this agreement. The resultant number wil be provided by each tea garden to the State Government, the Assam Valley Branch Consultative Committee of Plantation Associations and the Assam chah Mazdoor Sangha for the purpose of record. 3. In distributing these 23,000 workers credit will be given to those gardens who have given permanent employment since 1.1.1984 in addition to the number allocated to such gardens as per previous agreement dated 20th November 1978. Tea Estate defaulted in implementations of earlier agreements without any reasonable cause shall make this up addition to this fresh allotment.4. Any problem that may arise in implementing these agreements on any estate will be resolved by mutual discussion between the parties to the agreement.
