Agreement Regarding New Promotional Grade Subordinate

And Other Monthly Rated Staff

SHORT RECITAL

The Memorandum of settlement dated 18th November, 1985 reached between the above Employers Association and the employees represented by the Assam Chah Mazdoor Sangha stipulates under clause 1 (e) of the terms of settlement that the new promotional grade, i.e. subordinate and other monthly rated staff, grade I, will be created in the scale of RS. 285-7-355-9-445. The Memorandum of settlement also will be effective form 1.11.1985 with the next increment being payable on 1.4.1986.

The settlement daterd 18-11-1985 further provides that the norms and criteria for promotion form Grade II to Grade Iof subordinate and other monthly rated staff will be discussed between the parties and decided within 31-12-1985. The discussion however could not be held within the stipulated date and the parties held discussion today and a settlement was reached on the following Settlement;

Terms of Settlement:

1.(a) It is agreed that without prejudice to the rights of the Management for promoting workers form One Grade to another the Promotion of the sub-staff and other monthly rated workers form Grade II to the sub-staff and other worker monthly rated promotional Grade I. will generally be in accordance with the following norms:

For every sirdars in sub-staff and other monthly rated Grade II who have completed fifteen years of services in that grade, one shall be placed in Grade I, provided that atleast on e sirdiar with fifteen years service in the sub-ordinate and other monthly rated Grade II will be acres and above even when the above ratio does not warrant such promotion.

1. (b) The above promotion to grade 1 will be accordance with the accepted principles of seniority and efficiency.

1.(c) The promotion to Grade I will not result in any consequential vacancy in the lower grade of the sub-ordinate and other monthly rated workers.

1.(d) If any difficulty is experienced in implementation the provisions of this agreement it will be reviewed by the parties in due course.

2. Subordinate and other monthly trated employees who are in Grade II and are eluguble for promotion as per the above terms of settlement will be promoted with retrospective effect form 1-11-1985 and they will be fitted in the new pay scale in Grade on or before 1st April, 1986

3. Arrear wages that will be payable in view of promotion to the concerned employees wil be paid on or before 30th April, 1986.

4. In respect of these employees the annual increment will be given on 1-4-1986 in the new grade.

5. During the pendency of this agreement the employees and the Union will not raise any industry-wise dispute in respect of issues covered in this agreement.
