MEMORANDUM OF SETTLEMENT

SHORT RECITAL:

 

     The tenure of the Industry wise agreement dated 30th November, 2005 on wages for daily – rated workers in the Assam Valley having expired on the 31st December, 2009, the Assam Chah Mazdoor Sangha demanded revision of wage rates. Accordingly, bipartite negotiations took place between the Assam Chah Mazdoor Sangha and the Employers’ Associations on Various Dates at Dibrugarh.    

             

   In course of discussions the Employers’ representatives stressed on the long term sustainability of Industry. It was also agreed that productivity issues need to be addressed immediately.

 

    Finally an agreement on the question of wages for the daily rated workers of the tea gardens in the Brahmaputra Valley was arrived at on 2ed  February, 2010 at Dibrugarh on the following terms:-

 

TERMS OF SETTLEMENT:

 

1. There will be an increase in the daily wages of Daily Rates Workers as follows: 

                    

                                   Period                                                                  Adult

 

From            01/01/2010 to 31/03/2011                           Rs.    8.00 per day

From            01/04/2011 to 30/06/2012                           Rs.    5.00 per day

From            01/07/2012 to 30/09/2013                           Rs.    5.00 per day

                   

2. The increase in daily wages as provided for in Clause 1 of this agreement shall be added to the present wages of Rs. 58.50.

 

3. The agreement will be given effect to from the period commencing on or after 1st February, 2010 and the arrears of wages form 01.01.2010 will be paid by 31st March, 2010. Any garden having any difficulty regarding payment of arrear wages should approach the local Branch Offices of the ACMS for necessary accommodation.

 

4. The Employers Associations expressed concern at the growing trend of absenteeism  of permanent workers and discussed ways and means with the Union to curb this trend. The Union appreciated the problem and agreed to co-operate with the garden management in their effort to reduce absenteeism.

 

5. This agreement will be deemed to a “Settlement” as defined in Section 2(p) of the Industrial Disputes Act and will be binding on the parties as provided for in Section 18 of the said Act.
