1. Parties to dispute:
The Tea Plantation Industry in the Assam
Valley represented by the five Employers Associations, namely:
1. Indian Tea association
2.Tea Association of India
3. Bharatiya Cha Parishad
4. Assam Tea Planters
associations
5. North Eastern Tea
Association
AND
The Employees represented by Assam Chah
Mazdoor Sangha.
2. Short Recital of the Case:
In terms of section 15 (B) of the
plantations Labour Act. nonresident permanent workers in tea
plantation are eligible for free residential accommodation on fulfilment of
certain conditions as laid down in the said Act. The issue was raised at
meeting of the Industrial Committee on Plantation held in New Delhi
on 20.8.1986 when it was agreed that attempts would be made to reach a
negotiated settlement between the employers and the unions operating in tea
plantations in Assam Valley.
Accordingly, at a bipartite meting held in Dibrugarh on 27th October, 1986,
when the following terms were agreed upon between the Employers Associations
and the Union:
1. That a non-resident permanent worker of
a Tea Plantation entitled to residential accommodation within the Plantation
under section 15 (B) of the Plantation Labour Act. will receive a
House Rent Allowance of Rs. 15/- per month.
2. In the event of any such workers
refusing allotment of housing accommodation offered by the management
the worker will not be entitled to
receive House Rent Allowance.
3. If
any non resident permanent worker is already n receipt of better facilities
in respect of housing he would continue
to enjoy the same
but in that case the concerned not be entitled to the house rent.
4. This agreement will take effect form 1st
March, 1987.
